ITTY BITTY KITTY COMMITTEE ADOPTION AGREEMENT

The Itty Bitty Kitty Committee Executive Officers (the "Charity/we/us"), consisting of Leslie Thomas, Rachel Burgess, Debbie Knight, Kathy Lucas, and the undersigned (the "Adopter" or "you"), in consideration of the mutual promises and other good and valuable consideration in this Agreement, intending to be legally bound, agree to the following:

Description of the adoptive cat

Sterilization. In the event that the Cat has not been spayed or neutered prior to this adoption you agree to enter into a Sterilization Agreement with us simultaneously with this Agreement, and agree to have the Cat sterilized in accordance with the terms and conditions of the Sterilization Agreement.
You are responsible for any and all veterinary expenses from the time of adoption.
No Representations. You understand that this Cat was previously unwanted or lost and may have been rescued from a dangerous, unhealthy and/or cruel situation. This could result in the Cat's emotional or physical illness. You agree that we are making no representations or warranties about the temperament, personality or condition of the Cat.
Care of the Cat. You agree to provide to the Cat every day, free run of your house, fresh water, wholesome cat food, a clean litter box, and affection. You agree to keep the cat for its whole life. For health and safety reasons, we strongly discourage you from allowing the Cat outdoors. Cats that do not go outdoors have been shown to live significantly longer and healthier lives.
Veterinary Care. You agree to have the Cat examined by a licensed veterinarian annually. In case of illness or injury, you agree to seek prompt veterinary care.
No Transfers of Cat; Returning a Cat; Euthanasia. You agree not to abandon, give away, sell, or dispose of the Cat in any way. If you determine you no longer want to, or no longer can keep the Cat, you must make an appointment to return the Cat to us. The cat will be placed back up for adoption through our group. The adoption fee is non refundable. You will not ask a veterinarian to euthanize the Cat, except in the case of terminal illness or massive injury.
Lost Cat. You agree to make a serious effort to find the Cat if it becomes lost, by immediately (a) conducting a detailed physical search of your yard and your neighbors' yards, (b) setting humane traps in your yard to catch the Cat, (c) filing lost reports with the local police, animal control authorities, animal shelters, SPCA's, and local veterinarians, (d) posting lost cat signs, and (e) contacting us for additional advice. Escaped cats usually hide, don't meow, and won't respond to your calls, so you must search thoroughly high and low.
Breach of Agreement; Liquidated Damages. In the event that you do not comply with the terms of this Agreement or the Cat is abused or neglected, one of our remedies will be to recover the Cat from you upon demand. Promptly after the demand you will meet us, or we will come to your home, and you will surrender the Cat to us immediately. In addition, without waiving any of our rights under this Agreement, if you do not surrender the Cat to us, you will owe us a payment in the amount of Five Hundred Dollars ($500.00), agreed between us as just and reasonable liquidated damages to compensate us for our costs and expenses in connection with your breach of this Agreement.
No Liability. The Charity is not liable to you or any other party for any losses, injuries, damages, costs, expenses, liabilities, lawsuits or judgments whatsoever in connection with your adoption or ownership of the Cat.
Entire Agreement; Modification; Binding Effect. This Agreement is the entire agreement between us and you, and supersedes any prior understandings between us and you with respect to the subject matter hereof. No modification of this Agreement will be valid unless in writing duly signed by both us and you. This Agreement is binding on our and your successors, heirs, assigns, executors and personal representatives.
